Refund and Non-Usage Policy

Thank you for being a part of wabasuit - a product by KISHIVA CONSULTING SERVICES PVT LTD. 

Please attentively read the following information to learn about and understand our Refund and Non-Usage Policy.

Refund Policy

  1. Non-Refundable Fees:
    1. All Subscription Fees paid for accessing the wabasuit platform are non-transferable and non-refundable. 
    2. Wallet recharges made for Usage Fees (e.g., WhatsApp Business API messaging) are also non-refundable and non-transferable.
  2. Refunds for Service Failures:
    1. If the Solution fails to meet the agreed-upon Target Availability (95% uptime per financial year) for two consecutive months, the Client may terminate the agreement and request a refund of any Fees paid for the utilization of the Solution during this period.

Non-Usage Policy

  1. Subscription Commencement Date:
    1. The Subscription Commencement Date remains fixed irrespective of delays caused by the Client in implementing or using the Solution. 
    2. Non-usage or delayed usage does not affect payment obligations.
  2. Payment Obligations:
    1. The Client is obligated to pay all applicable Fees (Subscription and Usage) as per the agreed terms, regardless of whether they actively use the wabasuit platform during the subscription period or not.
  3. Suspension Due to Non-Payment:
    1. The Company reserves the right to suspend access to the wabasuit platform if Usage Fees or Subscription Fees are not paid within the stipulated time frame. 
    2. Suspension does not waive payment obligations, and interest may be applied to overdue amounts at a rate of 2% per month (or as permitted by law).
  4. Termination Due to Non-Usage:
    1. Non-usage does not automatically terminate the subscription agreement. 
    2. Termination must be explicitly communicated in writing by the Client before as per termination clauses outlined in the Terms of Use.

This policy ensures transparency regarding refunds and payment obligations in cases of non-usage or service interruptions.
