This Legal and Intellectual Property Notice ("Notice") forms part of, and should be read together with, the Terms and Conditions and the Privacy Policy governing the use of https://www.wabasuit.com (the "Site") and the wabasuit platform and services (the "Services"). The Site and Services are operated by KISHIVA Consulting Services Pvt. Ltd. ("wabasuit", "we", "us", or "our"), a company incorporated in India.
1. Our intellectual property. All content on the Site and within the Services — including the "wabasuit" name and logo, software, source code, designs, text, images, templates, documentation, workflows, and the look and feel of the Site — is owned by, or licensed to, KISHIVA Consulting Services Pvt. Ltd. and is protected under applicable Indian and international intellectual property law. All rights are reserved.
2. Third-party trademarks and references. The Site and Services reference, describe, or interoperate with products and services offered by third parties. All product names, brand names, logos, and trademarks referenced on the Site are the property of their respective owners. References to third-party marks are made solely for purposes of identification, description, and interoperability and do not imply affiliation, sponsorship, or endorsement by the respective owners, except where an active commercial relationship is expressly stated in writing. Each third-party mark is used in accordance with the rights holder's published brand-use guidelines, as in effect from time to time, or otherwise on a nominative-use basis recognised under applicable law.
3. Limited license to users. Subject to your compliance with our Terms and Conditions and applicable law, we grant you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Site and Services for their intended business purpose. You must not copy, modify, reverse engineer, decompile, scrape, frame, mirror, redistribute, or create derivative works of any part of the Site or Services, or use any content available through them to train any machine-learning or generative-AI system, except as we expressly authorise in writing or as required to be permitted by applicable mandatory law.
4. User content. You retain ownership of any content you submit through the Services ("User Content"). By submitting User Content, you grant us a worldwide, royalty-free, non-exclusive license to host, store, process, and transmit it solely to provide the Services to you and to comply with applicable law and platform requirements. You represent and warrant that you have all rights necessary to submit the User Content and that it does not infringe any third-party right.
5. Your responsibility. You are solely responsible for ensuring that the messages, templates, contact lists, campaigns, products, and brand names you use through the Services comply with applicable law — including intellectual property, consumer-protection, advertising, electronic-communications, and data-protection law — in every jurisdiction in which you and your recipients are located, and with the terms of the WhatsApp Business Platform and any other third-party platform you use through us. wabasuit does not represent or warrant that your specific use of the Services will be lawful or non-infringing.
6. Intellectual property complaints. If you believe that content on the Site or made available through the Services infringes your intellectual property rights, please contact us with (a) identification of the content and where it appears, (b) the right you claim and its basis, (c) your contact details, and (d) a statement that the information you have provided is accurate. We will review the complaint and take such action as we consider appropriate under applicable law.
7. No warranties; limitation of liability. The Site and Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, wabasuit disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Our aggregate liability arising out of or in connection with the Site and Services is limited as set out in the Terms and Conditions. Nothing in this Notice limits any liability that cannot be excluded under applicable law.
8. Changes and governing law. We may update this Notice at any time. The "Last updated" date at the top reflects the most recent revision. This Notice is governed by the laws of India and, subject to the dispute-resolution clause in the Terms and Conditions, is subject to the exclusive jurisdiction of the courts at Ahmedabad, Gujarat, India, without prejudice to any mandatory rights of consumers or rights holders under their local law.
